These terms and conditions of sale apply to all transactions for the sale of goods on the website. Please read them carefully. They do not affect your statutory rights.

Prices and Promotions

All prices and charges on the website are shown in UK pounds sterling. They include any VAT payable but do not include delivery charges. We are not responsible for any other importation taxes, sales taxes or charges that may be levied at the delivery destination. Although we endeavour to ensure that all pricing information on the website is correct, occasionally an error may occur and goods may be mispriced. In this event we will contact you via e-mail to make you aware of the correct price and to ask whether you wish to proceed with your order at the revised price or whether you would rather cancel. We will not be obliged to supply goods at the incorrect price. Prices that are reduced for sales and promotions are only valid for the stated period. We reserve the right to adjust prices, offers, goods and specifications of goods on the website at any time. This will not affect confirmed orders.

Online Purchase

Simply browse our store and add any items in the appropriate size to the cart. When you have completed your selection, proceed to the checkout where you will be asked for the necessary information required to process your order. You will have the opportunity to amend or abort your order up until the point that you submit the order on the secure page. All orders made by you through the website are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you in the circumstances. After submitting your order we will send you a transaction confirmation e-mail and an order acknowledgement e-mail with the appropriate order number and details of the goods which you have ordered. Please note that this is an acknowledgement of your order and not an acceptance. Acceptance of your order and the formation of a contract between us will take place when we send you an e-mail stating that the goods which you have ordered have been despatched.

Payment and Security

The total cost of your order is the total cost of the goods ordered plus the delivery charge and will be confirmed to you on the final step before you submit your order. Security is probably one of the most significant concerns for a shopper during an online transaction. In reality, an online transaction is probably more secure than a card transaction in a shop or conducted over the telephone as the information transmitted online is heavily encrypted. The payment process is handled by Worldpay, to ensure the security and integrity of all sensitive data. Alternatively, PayPal allows anyone to pay securely any way they prefer and has quickly become a global leader in online payment solutions. PayPal enables global ecommerce by making payments possible across different locations, currencies and languages. If the issuer of your card refuses to authorise payment we will not accept your order and we will not be liable for providing you with a reason for their refusal. We are not responsible for your card issuer or bank charging you as a result of your transaction as payment for your order.

We offer UK delivery only. All deliveries will be using Royal Mail and we will constantly check delivery rates to make sure you are getting the best deal for your online purchases with Barley Sugar.

Delivery Rates

These are the delivery routes most commonly used and the charges associated with them. If you have any special delivery requests please get in touch and we will be happy to help.

Standard UK Delivery

Orders to the UK mainland over £50 will be delivered free of charge - the exception being some heavy or oversized items. Where this is the case, the specific delivery charge will be very clearly highlighted on the product page itself, so you are aware of this before you checkout.

For orders of less than £50, we charge just £4.50 for delivery. For this price you can order as many items as you like. Again, there may be a few heavy or oversized items that are excluded from this price, but where this is the case the specific delivery charge will be highlighted on the product page itself, so you are aware of this before you checkout.

Orders will be sent using our secure courier service or Royal Mail recorded delivery according to the size and weight of the item. We endeavour to dispatch all items held in stock within two working days of receiving your order. In the unlikely event an item is out of stock, we will notify you and agree a solution.

Barley Sugar do NOT ship goods outside of the UK.

All orders placed before 2pm will be dispatched on the same day. All orders placed after 2pm or on a Saturday, Sunday or on a Bank Holiday will be dispatched on the next working day.

If the goods are lost in transit please contact our customer services team quoting your order number and delivery address and we will investigate with the carrier. Once the goods have been delivered to you all risk of damage to, or the loss of, the goods shall pass to you. If you choose to cancel your order in accordance with the cancellation and returns policy you must take good care of the goods pending their return.

Returns/Exchange Policy

If you wish to return an item, please follow our Returns Procedure.

1. You must notify us within 48 hours of receiving your order either by email at info@barley-sugar.co.uk or telephone: 01323 720045, quoting your name and order number.

Full priced items must be returned in new, unworn and unused condition with original garment tags still attached, 30 days after receipt. Barley Sugar will not accept returns of non-faulty items that have been worn, used and/or garment tags removed. In such cases, the item will be returned to the customer.

Sale items must be returned in new, unworn and unused condition with original garment tags still attached, 7 days after receipt. Barley Sugar will not accept returns of non-faulty items that have been worn, used and/or garment tags removed. In such cases, the item will be returned to the customer.

If you wish a refund, we will credit the original purchaser's card for the sum paid minus postage costs.

All refunds and exchanges for goods purchased via our website or by telephone must only be returned to the shop address stated below.

Please note that the customer is responsible for all postage costs incurred when returning items. Barley Sugar will not offer a refund on returned items, which are lost or damaged in the post. We strongly recommend that items are returned using registered post and that you keep your proof of posting certificate.

Barley Sugar will only reimburse postage costs in the case of faulty, damaged or incorrect supply of goods.

Please Note: Refunds can take up to 14 days to process.

If you wish to exchange any items from your order, we offer all our customers free delivery providing it is within the 30 day time frame.

If items have been bought prior to sale time, the difference in sale price and full price may be refunded if the items were bought within 30 days and are still in stock online.

Disclaimer

Please ensure that the e-mail address you give to us is correct. All order confirmations will be sent to this address and it is your responsibility that your mailbox is in proper working order. You assume the consequences for transmission or operational failures in using this website, the user shall agree to indemnify us against all claims, liability, damages, losses and costs arising from any breach of these conditions by the user or the use by any person accessing the website using user’s membership information.

Privacy

Privacy Barley Sugar is committed to protecting your privacy. We will only use the the information collected lawfully in accordance with the Data Protection Act 1988. The information we collect about you includes your name, address, phone number and e-mail address. We require this information to process your order and to provide you the best possible customer service. We will only send emails to you if you have first given permission ie. via our mailing list, and you will be given the opportunity to unsubscribe at any time. Under no circumstances will Barley Sugar share your personal information with any other party. We do not collate sensitive information on you, and any information we hold will be accurate and up to date. You can contact us at any tome to enquire what personal information we have and if any inaccuracies are found we will amend this immediately. All personal information will be held securely and in accordance with our internal security procedure and legal requirements.

Severance

Each provision of these terms and conditions of sale shall be construed separately and independently of one another and the validity of any one part shall not affect the validity of any other part.
